You should join your state chapter through the IV forums. State Chapter volunteers should plan to contact local politicians and meet them face to face. Nothing is more powerful than visiting face to face and impressing upon politicians how important this issue is.

I have an issue with my I-94 and need your advice on this.
I came back to US from India vacation on 10-Sep-2007. My H1 Papers from Company-B got approved(on 5-Sep-2007) just before I start from India . So I could not show the new Company-B h1 papers at the Port of entry to the CBP officer. I got my new I-94 date based on the old Company-A H1 papers which is valid till 30-Sep-2007.
I red on the Immigration Forums that USCIS follows last action rule to determine the validity of I-94. In that scenario, the I-94 that comes with my new H1 paper gets invalidated. If it is true, am I out of status after 30-Sep-2007?
Could you please advice on my possible options on this issue?

My case got LUD 8/5 , I filed my I-485 on 2nd july... She spoke to me nicely and told me that there is no update or no entry of my case... Wait for few weeks..... TSC.........wait....... TSC...

H1 would be valid/active the moment you accept employment with H1-B sponsoring employer.
Since you haven't started working and assuming you haven't accepted the offer from the
H1 sponsoring employer, YOU should be fine.
Please take advise from your company attorney.

I think you cant work internationally and invoke AC21. It doesnt make any sense. However, you can work internationally without invoking AC21 and still keep the GC process alive, because GC is for a future position.

What if you have AP but not used it, instead used the re-validation rule to enter into the country, using H1. Would that invoke abandonment of 485?
The scenario covers people who are working on H1B and have their I-485 pending and have not applied for AP and have a expired H1B visa stamp on their passport. It doesn't matter if they have a H1B extension on hand with a new I-94 stub. If they travel abroad, it could very well be considered as an abandonment although they might be permitted to re-enter under "automatic visa revalidation" rule.
If I've I-485 pending, i would never travel without an AP.

After the transitional period, the Service Centers will return any incorrectly filed Form I-485 with instructions to send the application to the correct location.

The upside-down "V" shaped branches in the upper left corner are distracting, but could probably be cloned out with a bit of work in PS. The bright leaves in the upper right corner are also distracting, but a bit of burning in could probably make them stand out less. The water is blown out down at the bottom, but that's easy to excuse if you're using a P&S where you don't have much control over the exposure - or even a way to reliably gauge it until the image is on your computer monitor. Overall, the image has potential, and it shouldn't be too hard to fix most of the little issues I see with a bit of time in Photoshop. :)

One of my friends is saying Job experience with the same company would not count towards? So this means will i have to change jobs and hope that my I-140 for the current employer is not withdrawn. Pl. advise.

I own a couple of lenses for a canon camera and would like to get a Nikon D70. Something that would greatly encourage me to do so would be if I could use my current lenses with the D70. I have found some adapters but I have no clue which one I would need. One lens is a Canon EF 28-80mm and the other is a Sigma 100-300mm if that helps. Hopefully somebody here knows. The staff at camera shops usually never respond to my emails, unless I have bought something or I tell them i am going to buy something from them soon. :rolleyes:

Your application and your wife applications are different though she applied as dependent on your application both I-485 applications are treated separately.
So you will be on H1 though your wife uses her EAD. My friend is also in the same status and he is waiting for an answer from an attorney. I would update here once he hear back from attorney.

As far as I know/understsand : to be eligible for H1B visa for 2010, a company should applke for H1B on april 1st 2010, so that the person gets it by october 1 2010 right??
if the 65000 limit is still available , lets say after october 1st 2010, can the company still apply for H1B after october 1st or november or even ion december, as long as the H1B cap 65000 is still available??

Since the lower background is dark, I think it works well. The blossom really stands out with a feeling of depth, just the right DoF. There are two points on the left (probably sepals from the next blossom?) that are a little distracting to me, but that's a nitpick.

I was on regular H1B for three years until mid 2008 when I changed to H4 status. Now, if I want to work for a non-profit organization, does the org have to just transfer the original H1B or file a new non-profit petition. If it is the latter (new petition) what happens to my original H1 approval? If I want to go back to the for-profit world do I need to apply for a new H1 or will my original H1 validity continue??

You can apply for change of status (COS) from H4 to H1 at any time of the year, if your employer is cap exempt (non-profit) and you have not completed 6 years of maximum stay on H1B/L1. You will not be counted again in cap, so you can return to for-profit employer at any time provided you have not completed 6 years of maximum stay in H1/L1. In order to stay on H1 beyond 6 years, you need to have a labor pending for more than 365 days or 140 approved.

My wife's passport was received from Delhi Consulate after about 21 business days.
My wife attended the H4 interview on Jan-11 and the VO asked 3 basic question of what does your husband do, what do you do and why are you going. No pink or green or any slip was given and nor my wife was told that her visa hasa been approved. All she was told was that they have to do some background processing after which they will send the passport back.
So what was supposed to be 2-3 days of work stretched for ever, off course flights had to be cancelled and wife had to drop the semester and my daughter had to miss the school as well. My wife's AP was approved after she had left for India,so couldn't even use that.
I know there is nothing an applicant can do or not do, but it just bothers me how much anguish this causes to not just the applicant but all of the immediate family and there is nothing that can be done.
I wish good luck to all who are stuck and hopefully in future this process might be more streamlined and have faster turnaround.

1. Is it Mandatory to file AC21? No
2. Is AC21 required for each contract switch ? (Suppose Contract is W2), if so, wouldnt that be hard and expensive to file for every 3 or 6 months projects? "contract". You are doomed. GC is for "permanant full time" offer. So, new job based on AC21 should also be "permanant full time". If USCIS knows that you are working on a cotracr for a short term; wait for 485 denial notice.
